Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and BookyTails (operated by Toan Duy Bui, sole proprietor, Texas, USA). By creating an account, subscribing, or using the service, you agree to these Terms. If you don't agree, don't use the service.

1. The service

BookyTails provides software for independent groomers to manage customer intake, scheduling, appointments, billing, communication, and reporting. We may add, change, or remove features; we'll give reasonable notice for material changes that affect your active workflows.

BookyTails is a software platform, not a grooming service. Groomers who use BookyTails are independent operators. They are not our employees, agents, partners, or contractors, and we do not supervise, inspect, train, license, or insure them. We do not provide grooming services and are not party to any grooming appointment booked through the platform. Any grooming services - including any injury, allergic reaction, behavioral incident, property damage, or dispute arising from a grooming appointment - are solely between the customer (pet owner) and the independent groomer. We disclaim all liability for the conduct, skill, qualifications, or outcomes of any groomer using BookyTails. 2. Eligibility

You must be at least 18 years old and authorized to enter into binding contracts on behalf of yourself or your business. BookyTails is intended for business use; personal accounts are permitted but the service isn't designed for non-business use cases.

Your use of BookyTails is also governed by our Acceptable Use Policy, which explains what's prohibited (spam, illegal content, scraping, impersonation, abuse of SMS, etc.). Violations may result in suspension or termination without refund.

6. SMS and TCPA compliance

BookyTails sends SMS to your customers on your behalf as part of the service. You, as the sender of record, are responsible for complying with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any applicable state laws. This means:

If we're notified of TCPA complaints involving your account, we may suspend SMS sending until the issue is resolved.

BookyTails uses AI (currently Anthropic Claude) to suggest grooming services, estimate quotes from photos, and parse receipts. AI output is a recommendation, not an authoritative determination. You review and adjust before sending to your customer. We're not liable for losses arising from your decision to act on a particular AI suggestion without review.

BookyTails is provided “as is” and “as available.” We disclaim, to the fullest extent permitted by law, all warranties (express, implied, or statutory) including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation. We don't warrant that AI output is accurate, that SMS will always be delivered, or that the service will be free of bugs.

11. Limitation of liability

To the fullest extent permitted by law, BookyTails' total cumulative liability arising out of or related to these Terms or your use of the service is limited to the greater of (a) the fees you paid BookyTails in the 12 months preceding the claim, or (b) US $100. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, even if we've been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold BookyTails harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from (a) your use of the service, (b) your violation of these Terms or applicable law, (c) your violation of a third party's rights, or (d) the content you upload to or send through BookyTails.

13. Termination

You can cancel your subscription anytime from the billing page. We may suspend or terminate your account if you breach these Terms, our Acceptable Use Policy, or applicable law; in serious cases (fraud, illegal content, security threats) we may terminate immediately. Upon termination, your access to BookyTails ends; we'll retain your data for 90 days to allow export, then delete in line with our Privacy Policy.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Any disputes arising from these Terms will be resolved in the state or federal courts located in Hays County, Texas, and you consent to personal jurisdiction there. To the fullest extent permitted by law, you and BookyTails each waive any right to a jury trial.

We may update these Terms from time to time. For material changes we'll email active subscribers at least 30 days in advance. Your continued use of the service after the effective date of the change constitutes acceptance.
